By accessing or using the HomePort Estates platform and services (the “Service”), you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.

1. Introduction

HomePort Estates operates as a property matchmaking platform, connecting property buyers (individuals, investors, landlords) with sellers, agents, and service providers. We do not guarantee the success of any match, transaction, or relationship. By using our platform, you acknowledge that we act as an intermediary and are not a party to any resulting transaction.

2. Definitions

• “Service” Refers to all aspects of the platform and services provided by HomePort Estates.
• “User”: Refers to any individual or entity accessing or using the Service, including but not limited to buyers, investors, landlords, and service providers.
• “Match”: Refers to a suggested connection between a buyer and a property, or between a buyer and a service provider facilitated through HomePort Estates.

3. Eligibility

To access and use the Service, you must:

• Be at least 18 years old.
• Provide accurate, truthful, and up-to-date information when registering or accessing services.
• Be legally able to enter into binding contracts and agreements in your jurisdiction.

4. Identification Requirements

You must provide the necessary documents for verification as required by law or the platform’s policies. This may include government-issued identification and proof of address. HomePort Estates reserves the right to request additional documents at our discretion.

5. Service Description

HomePort Estates connects buyers, investors, landlords, and service providers to facilitate property matches. We act solely as an intermediary and do not guarantee any transaction or the completion of a property deal. Our service is intended to assist in connecting buyers and sellers, providing a platform for communication, and facilitating introductions.

6. Fees and Payment

Fees are applicable for accessing and using the Service. Fees are payable as outlined in the specific service offering you select. By using our services, you agree to pay the fees specified at the time of registration and as agreed upon in any relevant contract or arrangement.

• Matchmaking Fees: Charged when a connection is made between buyer and seller.
• Service Fees: Fees for additional services provided by HomePort Estates.

No Guarantee of Match: While we strive to facilitate beneficial connections, HomePort Estates does not guarantee that any match will lead to a successful transaction. Fees remain payable regardless of the outcome of the connection or transaction.

7. User Responsibilities

As a user of the Service, you agree to:

• Provide truthful and accurate information when registering and during any subsequent interactions.
• Comply with all applicable laws, including those related to property ownership, leasing, and renting.
• Respect the intellectual property rights of HomePort Estates and others.
• Not engage in fraudulent, misleading, or unethical conduct, including but not limited to misrepresenting property details, providing false information, or attempting to deceive other users.
• Do not misuse the platform for spam, phishing, or other harmful activities.

8. Registration and Account Security

By creating an account, you agree to keep your login details secure and not share them with third parties. You are responsible for any activity under your account. HomePort Estates is not liable for unauthorized use of your account if you do not comply with account security obligations.

9. Termination of Service

HomePort Estates reserves the right to suspend or terminate your access to the platform at any time, without notice, if:

• You violate any of these Terms and Conditions.
• Engage in fraudulent activity.
• Misuse the platform or conduct activities that harm or disrupt the operation of the platform.

In the event of termination, all fees paid are non-refundable unless explicitly stated otherwise. HomePort Estates may also discontinue the Service at its sole discretion.

10. Limitation of Liability

To the fullest extent permitted by law, HomePort Estates shall not be liable for:

• Any indirect, incidental, consequential, or special damages arising from your use of the Service.
• Loss of data, revenue, profits, or opportunities, whether foreseeable or not, arising from your use of the Service.
• The success or failure of any transaction, business relationship, or match facilitated through the Service.

HomePort Estates is not responsible for the actions of any third parties, including sellers, buyers, contractors, or service providers who may be introduced via the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless HomePort Estates, its affiliates, employees, contractors, and service providers from any claims, damages, or losses (including legal fees) arising out of your use of the platform or violation of these Terms.

12. Intellectual Property

All content, software, design, and materials provided on the Service are the exclusive property of HomePort Estates or its licensors. You may not copy, distribute, or otherwise use any of this content for commercial purposes without explicit permission from HomePort Estates.

13. User-Generated Content

Any content submitted by users (e.g., reviews, feedback, comments) remains the property of the user but grants HomePort Estates a non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with the Service.

Users are solely responsible for the content they submit, and by submitting it, you represent that you have the right to do so.

14. Privacy and Data Protection

HomePort Estates takes the privacy and security of your data seriously. The collection, use, and protection of your personal information are governed by our Privacy Policy, which you agree to by using the platform. This includes the sharing of personal details necessary for facilitating matches and connections with third parties, in compliance with applicable privacy laws.

15. Dispute Resolution and Governing Law

In the event of a dispute, you agree to first attempt to resolve the issue directly with HomePort Estates. If a resolution cannot be reached, the dispute will be resolved through arbitration or as governed by applicable local laws. You agree to submit to the exclusive jurisdiction of the courts of the jurisdiction in which HomePort Estates is based.

16. Amendments to Terms

HomePort Estates reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting. Your continued use of the Service after any changes signifies your acceptance of the updated Terms.
